Kilpatrick loses appeal to review jury records for racial makeup

Kwame Kilpatrick lost an appeal Friday of a judge's order denying him access to jury records in hopes of dismissing the City Hall corruption indictment because there aren't enough blacks in the jury pool. A three-judge panel said Friday that Kilpatrick's appeal is premature but could be reviewed if the former Detroit mayor is convicted and sentenced to prison.

"The District Court's ruling is effectively reviewable on appeal from the final judgment although the remedy for any alleged violation may require the dismissal of the charges against Kilpatrick," the judges wrote Friday.
