Weak Maryland Prosecutors Seek No jail time in Baltimore Neighborhood Watch Case: White Men Assaulted 15 yr old Black boy
/From [HERE] Maryland prosecutors are not seeking jail time for a former member of an Orthodox Jewish neighborhood watch group convicted in the beating of a black teenager, 15 year-old Corey Ausby.
Twenty-four-year-old Eliyahu Werdesheim faces sentencing Wednesday for second-degree assault and false imprisonment. His 22-year-old brother, Avi, was acquitted. The case drew comparisons to the fatal shooting of Florida teen Trayvon Martin.
Eliyahu Werdesheim faces up to 10 years on the assault count, but prosecutors are requesting a three-year suspended sentence, probation and community service. According to police records, Eliyahu, 24, was a member of Shomrim, an Orthodox Jewish citizens' watch group, on Nov. 19, 2010, when he and his brother allegedly confronted Ausby. Ausby was told that he didn't belong in the neighborhood, thrown to the ground and hit with a hand-held radio that Shomrim issued to Eliyahu, according to the state.
During a very dramatic trial one key witness, a retired Navy SEAL, testified that he saw the brothers follow the teen in their car. He says they told Ausby “you don’t belong around here.” He also said Ausby looked petrified. That story corroborates with what Ausby told police during the investigation. [MORE]
Werdesheim's attorney, who will argue a motion seeking a new trial, says scores of people sent the judge letters of support.
